Welcome to attestico, a service of Clym Inc. By accessing or using the attestico marketplace (the “Service”), you agree to the following terms and conditions (the “Terms”). These Terms apply to both service providers (the “Providers”) and customers (the “Customers”) using our platform.

1. About attestico

Attestico is a marketplace platform that connects Providers offering compliance-related services with Customers seeking those services. Attestico operates as a neutral intermediary and is not responsible for the content, quality, or performance of the services offered by Providers. The marketplace focuses on services related to:

  • Data Privacy: data privacy as a service, data representatives for EU, UK, Switzerland, and audit services.
  • Security: audits (e.g., SOC 2, ISO 27001), pentesting, incident response.
  • Accessibility: media accessibility, file accessibility, user testing, audit services, VPAT services.

2. Acceptance of Terms

By accessing or using the Service, you accept and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

3. Service providers and customers

a. Service providers
Providers may offer their services through the attestico marketplace. As a Provider, you are responsible for the content, accuracy, and legality of the services you provide. You agree that attestico may charge a commission on the services you provide via the platform, which will be clearly communicated to you.

b. Customers
Customers may browse and purchase services through the attestico marketplace at no charge. The service agreement, including any disputes or service performance issues, is solely between the Customer and the Provider. Attestico does not guarantee or endorse the quality, suitability, or legality of the services provided by Providers.

4. Fees for Providers

Attestico might charge a fee to Providers for listing their services on the marketplace. This fee will be clearly communicated to Providers before any listing is made. Customers are not charged for using the marketplace or for connecting with Providers. Any fees paid by Providers are non-refundable, regardless of whether a service transaction is completed.

5. Limitations of liability

Attestico acts solely as a facilitator between Providers and Customers. We do not provide, manage, or supervise any services. You agree that:

  • Attestico is not liable for any actions, omissions, or quality of the services provided by Providers.
  • Attestico will not be held responsible for any disputes between Customers and Providers, including but not limited to service performance, service outcomes, or any claims related to warranties, liabilities, or damages.
  • Attestico disclaims all implied warranties, including the warranties of merchantability, fitness for a particular purpose, and non-infringement.

6. Use of the platform

You agree to use the attestico marketplace only for lawful purposes and in accordance with these Terms. Providers must ensure that their services comply with all applicable laws and regulations. Any misuse of the platform by either party may result in termination of access to the Service.

7. No obligation to use services

Customers and Providers using attestico are not required to use Clym’s other services, including its digital compliance platform. Participation in attestico is independent of any other offerings from Clym Inc.

8. Indemnification

You agree to indemnify and hold harmless attestico (and Clym Inc.) from any claims, damages, liabilities, costs, or expenses arising out of your use of the Service, your violation of these Terms, or any actions related to your provision or use of services through the platform.

9. Termination

Attestico reserves the right to terminate or suspend your access to the platform at any time for any reason, including violation of these Terms.

10. Governing law

These Terms will be governed by and construed in accordance with the laws of California, USA.

11. Changes to these Terms

We reserve the right to modify or update these Terms at any time. Any changes will be posted on this page, and it is your responsibility to review them regularly. Continued use of the platform constitutes acceptance of the revised Terms.
